Client Agreement

This Client Agreement is entered between you, as a Client of PFC Club (India) Pvt Ltd, a fitness company having its office at Pune, Maharashtra 411014, through their training programs delivered online.

PLEASE READ THE FOLLOWING TERMS CAREFULLY BEFORE ENROLLING.

By enrolling for the services offered by PFC Club, or by agreeing to these terms where the option is made available to you, you signify your agreement and unequivocal, unconditional consent to these TERMS, as well as agree to waive any and all claims against PFC Club, its affiliates, trainers, agents, officers, directors, or employees arising out of your use of the Fitness Programs or any services therein. If you do not agree, you may not use the services. PFC Club may, at any time, modify these Terms/this Agreement without prior notice and your continued use of this program shall be conditioned upon the terms and conditions in force at the time of your use.

1. Services and Fees

PFC Club offers fitness programs customized for your specific needs and goals. The trainer shall provide consultation and recommendations based on the information provided by you. Such suggestions and regimes shall be provided on a chargeable basis, which shall be non-refundable. PFC Club reserves the right to revise such charges/fees from time to time.

2. Trainer Relationship

Trainers are employees and/or affiliates of PFC Club and shall not be construed to be agents of PFC Club and/or subsidiaries. Neither PFC Club nor any Trainer/Consultant shall be obliged to provide any services otherwise than in compliance with applicable laws.

3. Accuracy of Information

Any advice/regimen/diet provided by any trainer/consultant shall depend solely on the accuracy of the information provided by you. 

4. Plan Duration and Emergencies

Once you sign up for a program/plan for a specific duration, you are required to start the same within the duration chosen by you. In case of any emergency or unforeseen circumstances where you are unable to start it, you shall get an option to hold the plan for a maximum of 2 weeks from the date of payment, provided the same shall be communicated in writing to the coach assigned to you. Upon receiving the plans tailored for you, if there is any medical emergency or mishap, you shall have an option to hold the plan for a maximum period of 2 weeks.

5. Results and Guarantees

At PFC Club, we work with the best of our efforts after understanding your physical health and fitness goals. However, we do not guarantee any particular progress in terms of weight loss in any particular period of time. Further, we do not guarantee any particular result. Our aim is to give you the best possible plan that suits you. We do not claim or guarantee to fix any pre-existing health condition.

6. Privacy and Social Media

PFC Club shall not share and post your pictures on their social media channels without prior written consent from you.

7. Coach Availability

You shall have direct access to your coaches. However, our coaches are not available on Sundays and National Holidays. For any queries related to your fitness regimen, our coaches/trainers shall get back to you at their earliest convenience.

8. Supplements and Medical Advice

We do not, in any way, shape, or form use, encourage the use of any banned supplements/drugs or controlled substances of any kind. In the case where you are taking any supplements voluntarily, kindly inform us about the same. If you fail to reveal any such information, PFC Club shall not be responsible for any adverse outcome of the plan tailored for you in case of any mishap.

Nothing contained in our plans and advice either verbally, or over the phone or text message shall be construed as Medical Advice. Use of any banned or fake supplements/drugs shall be done under the directions and auspices of a licensed physician. The coach does not claim to be a medical doctor nor does he purport to issue medical advice.

9. Product Recommendations

We test and curate products for the community, but whatever you buy is a recommendation, and we are not responsible for the product, its quality, delivery, or anything related to it. The transaction is directly between you and the product company.

10. Limitation of Liability

Neither PFC Club nor any coaches/trainers shall assume any liability or responsibility for any claims, damages, consequences, and/or orders of any statutory bodies or consumer forums not arising from any default or negligence on the part of PFC Club or the relevant coach/trainer, as the case may be.

In no event shall PFC Club, its coaches, its trainers, its agents, its suppliers, or any third parties recommended by PFC Club be liable for any damages of whatsoever nature, resulting from the use of or inability to use the products and services, whether based on warranty, contract, tort, or any other applicable law. 

11. Representation and Warranty

You represent and warrant that you are of sufficient legal age to create binding legal obligations for any liability you may incur as a result of the use of our programs and services. You are responsible for maintaining the confidentiality of our methods and recommendations. Furthermore, you agree to accept responsibility for all activities that are designed as per the information provided by you.

12. Indemnity

You agree to defend, indemnify, and hold PFC Club, its coaches, trainers, officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions, or demands, liabilities, and settlements including, without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms of Use.

13. Governing Law and Jurisdiction

This Agreement is governed by and is to be construed in accordance with the laws of the Republic of India. Any suit, action, or proceeding seeking to enforce any provisions of, or based on any matter arising out of or in connection with, this Agreement or the Transactions may be brought in a court sitting in Pune, India, and each of the Parties hereby consents to the non-exclusive jurisdiction of such courts.

14. Arbitration

In case of any dispute or difference arising out of or connected with or relating to this Agreement/these terms, the same shall be referred to arbitration under the Arbitration and Conciliation Act, 1996 or any statutory modification or re-enactment thereof for the time being in force. The arbitration shall be referred to one arbitrator who will be appointed by PFC Club. The venue of Arbitration will be Pune, Maharashtra 411014.

15. Complaints

Members are advised to address their complaints, if any, to the support team at support@thepfc.club. They are there to help you out. However, if you are not satisfied, you may write to PFC Club founders at chirag@thepfc.club, ankit@thepfc.club.
